Assumption of Risk, Waiver, and Release from Liability for All Claims of Any Type for Damages of Parents, Guardians, and Minors (“Release and Waiver”)

In consideration of being allowed to enter the play area at Precious J.E.M.S., LLC, located at 4102 W 183rd Street, Country Club Hills, IL 60478 (“Precious J.E.M.S.”), to use any equipment or participate in any event and/or party, the undersigned, on their own behalf and on behalf of the minor(s) listed below, enters into this release and waiver as follows:

 

Assumption of Risk and Waiver of Claims

The undersigned knowingly, voluntarily, and fully assumes all risks—known and unknown—associated with attendance at or participation in any and all activities, programs, parties, or other events at the Precious J.E.M.S. facility. They waive all claims for damage to personal property or injury to persons arising from such participation and expressly release and waive any and all claims for damages. The undersigned hereby surrenders and waives any rights to sue or exercise any legal right to seek damages against Precious J.E.M.S. or any affiliates, including its owners, officers, members, agents, employees, affiliates, and other persons or entities acting on their behalf.

This release and waiver covers risks of death, serious injury, and property loss arising from negligence or carelessness or gross negligence on the part of the persons or entities being released and other participants.

 

Physical Fitness and Responsibility for Food and Drink

The undersigned certifies that they are physically fit to participate in the activities at the Precious J.E.M.S. facility and have not been advised to the contrary by a qualified medical professional. They further certify that they are solely responsible for their consumption of any food or drink while at the Precious J.E.M.S. facility.

 

Release of Liability

The undersigned, on behalf of themselves and any executors, heirs, successors, and assigns, releases, discharges, and holds harmless any authorized entity doing business as Precious J.E.M.S., including its owners, officers, members, agents, employees, affiliates, and other persons or entities acting on their behalf, from any and all claims, damages, or liability arising from death, disability, personal injury, property damage, theft, or any kind of action.

This indemnity covers risks of death, serious injury, and property loss arising from negligence or carelessness or gross negligence on the part of the persons or entities being indemnified.

 

Responsibility for Damages

The undersigned agrees to pay for any damages to the facilities of Precious J.E.M.S. caused by them or their family’s negligent, reckless, or willful actions.

 

Adherence to Rules and Conditions of Participation

The undersigned agrees to abide by all rules and conditions of participation and/or attendance posted at or explained by an employee of Precious J.E.M.S. facility. If the undersigned experiences any significant hazard or injury during participation, they will promptly inform an employee.

 

Acknowledgment and Reliance

The undersigned acknowledges that this release and waiver of liability form will be used and relied upon by Precious J.E.M.S., and that it will govern the undersigned’s actions and rights.

 

Additional Rules for Participation

• Shoes are not allowed on the play floor, and socks must be worn at all times.
• Adults must supervise their children at all times.
• Food is not allowed on the play floor.
• All participants must show respect to others, employees, and the equipment at all times.

 

Requirement for Signed Waiver

Each participant must have a form signed by themselves or, if under 18, by a legal guardian/parent/designated representative. If a membership is purchased, this waiver will cover the length of the membership.

 

Indemnification for Legal Fees

The undersigned agrees to indemnify Precious J.E.M.S. for any attorneys’ fees and/or costs incurred to enforce this agreement, including all costs associated with any collection efforts.

 

Severability

Any provision of this Agreement that is prohibited or unenforceable shall be deemed ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions, which shall all remain in full force and effect.

 

Authority of the Signatory

I represent that I am the parent or legal guardian of the child(ren) named below, or have obtained permission from their parent/legal guardian to execute this agreement on their behalf. I agree that the child(ren) named below and I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions for participation in any program and/or class at Precious J.E.M.S.

I am aware that there are inherent risks associated with participation in Precious J.E.M.S. activities, events, parties, and/or use of the play area and/or party rooms. I either have full knowledge and understanding of the nature and extent of such risks or recognize that some risks may be unknown and sign this document acknowledging it shall be effective with respect to such risks.

I, on behalf of myself and the child(ren) named below, knowingly and freely assume all such risks, including, but not limited to, personal injury, death, and property damage, and those risks arising out of participation in any and all Precious J.E.M.S. activities, events, parties, or use of the play area and/or party rooms.

 

Arbitration Clause

Any controversy, dispute, or claim arising out of or related to this Agreement, which the parties cannot resolve by mutual agreement, shall be settled exclusively by binding arbitration before a single arbitrator within 25 miles of the facility, per the rules of the American Arbitration Association.

 

Governing Law

This Waiver and Release is intended to be as broad and inclusive as permitted by Illinois law and shall be governed and interpreted accordingly. If any provision of this Waiver and Release is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
